This Liability Disclaimer governs all interactions with Artchemira, including use of the website, purchases of products, workshops, coaching sessions, events, and other services (collectively, “Services”). By using our Services or attending any Artchemira activity, participants and customers agree to the terms herein.

1. General Liability Exclusion

Artchemira strives to provide high-quality products, safe workshop environments, and responsible coaching practices. To the fullest extent permitted by Swiss law, Artchemira shall not be liable for any direct, indirect, or consequential damages arising from the use of our website, Services, or products, except in cases of gross negligence or wilful misconduct.

2. Workshops & Creative Sessions

Participation in any Artchemira workshop, event, or creative session is voluntary and at the participant’s own risk.

a) Physical Risks & Premises Safety
Workshops may involve materials such as paints, inks, brushes, sharp tools, or water. Risks include, but are not limited to:

  • Stains or damage to clothing, bags, or personal belongings
  • Minor cuts, spills, slips, or injuries
  • Allergic reactions to paints, inks, or other materials

Workshops may take place on Artchemira premises or rented venues. While safety measures are in place, Artchemira is not responsible for accidents, injuries, theft, or loss occurring on-site. Third-party venues may also have their own safety rules or liability terms that participants agree to follow.

Participant Responsibilities:

  • Wear suitable clothing and follow all safety instructions
  • Disclose any allergies or sensitivities before  participation
  • Ensure they are physically fit to participate
  • Take responsibility for their own personal property
  • Minors may participate only with parental consent and supervision where applicable.

3. Coaching Sessions (1:1, Group, or Team)

Artchemira disclaims any liability for emotional distress, personal decisions, or interpretations related to coaching content.

Participants accept responsibility for their emotional well-being throughout the program and assume responsibility for any emotional distress arising from engagement with coaching content or related personal decisions.

By participating, individuals affirm their understanding and acceptance of these terms and conditions.

Artchemira coaching focuses on creativity, personal development, and self-discovery. Coaching is not a substitute for psychotherapy, medical treatment, or psychological advice, nor is it a substitute for any of them.

Participants acknowledge:

  • Emotional reactions, memories, or discomfort may arise
  • Artchemira does not guarantee specific psychological outcomes
  • Those with pre-existing psychological or mental health conditions should consult a qualified professional before participation

4. Products & Handmade Goods

a) Product Use & Safety

  • All products must be used according to instructions
  • Misuse, accidents, or allergic reactions are the sole responsibility of the user
  • Age restrictions, if indicated, should be strictly followed to ensure safe and proper usage. (e.g., certain inks, paints, or tools).
  • General caution for children: Even products without a formal age restriction may present risks if handled unsupervised. Caregivers are responsible for supervising children and ensuring safe use of all materials, including journals, stickers, kits, and tools.

Artchemira is not liable for injuries, accidents, or misuse by children or other users who do not follow usage instructions.

b) Handmade Items

  • Variations in colour, size, or texture are normal and not considered defects

5. Events & Group Activities

Participants assume full responsibility for their behaviour, interactions with others, and personal property. Artchemira is not liable for:

  • Conflicts between participants
  • Loss or damage to personal items
  • Incidents occurring outside structured activities

Participants will be informed if photos or videos are taken during workshops or events. Consent will be requested before any identifiable images are used for Artchemira’s communication or marketing.

6. Intellectual & Creative Output

Participants may create artwork, writings, or other materials during workshops or coaching. Artchemira is not responsible for:

  • Loss, damage, or sharing of participant-created content outside official channels
  • Misinterpretation of prompts, exercises, or advice

7. Force Majeure

Artchemira is not liable for delays, cancellations, or changes caused by circumstances beyond its reasonable control, including:

  • Pandemics, natural disasters, or weather events
  • Transportation or logistical issues
  • Venue problems or government restrictions

Where feasible, Artchemira will reschedule sessions or offer credits, but financial liability is limited to the original payment.

8. Participant Responsibilities

By using our Services, participants agree to:

  • Follow instructions provided by Artchemira facilitators
  • Act respectfully and responsibly
  • Disclose any relevant allergies or health conditions
  • Ensure physical and mental readiness to participate
  • Seek external medical or psychological advice when needed
  • Consider insuring personal property if desired
  • Failure to comply may result in exclusion from activities without refund.

9. Legal Enforcement & Jurisdiction:

This Liability Disclaimer is governed by Swiss law, and the place of jurisdiction is Switzerland.
Consumer protection laws in the participant’s country may apply where relevant.
Liability is excluded to the fullest extent permitted by law, except for damages resulting from gross negligence or wilful misconduct.

10  Safety & Protection:

  • Participants should ensure they have their personal belongings if desired.
  • Encourage appropriate clothing or protective gear during workshops.
  • Participants are responsible for managing their allergies; Artchemira provides material information where possible.

If any provision of this disclaimer is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
